Keyyes Membership Conditions
KEYYES PRIVATE MEMBERSHIP TERMS & CONDITIONS
In these terms and conditions (the ‘Conditions’), ‘Keyyes' will mean Sarment (S) Pte. Ltd. and the ‘Member’ will mean You, a person who has become a Keyyes member by accepting these Conditions after being deemed eligible for membership by Keyyes (the ‘Membership’). Please read these Conditions carefully before accepting them. By accepting these Conditions You agree that you have read them and that you accept and agree to be bound by them and you confirm that you are 18 years old or over.ou confirm that you are 18 years old or over.
Details of the different levels of Membership, duration and associated fees can be found on our website www.keyyes.com and in our app. Supplementary Membership is only available to eligible individuals who are: (i) are 18 years old or over; and (ii) resident in the same country as the primary member.
Keyyes shall make every reasonable effort to ensure that You enjoy the products and services offered by us or our partners under the Membership but we do provide warranties regarding the services we offer. We also cannot offer further warranties than what is offered by our partners in regard to products and services you order under your Membership. Keyyes has a reasonable efforts obligation in everything we do. We trust you understand. Keyyes is not liable to You other than as stated in mandatory consumer law.
Prices are subject to change without prior notice and all orders are subject to Keyyes's acceptance at our sole discretion and availability. As You know it is illegal to sell alcohol to people under the legal drinking and alcohol purchase age. If the delivery includes alcoholic drinks or any other age-restricted items, which may not be delivered to a minor, please ensure a person of legal drinking age with appropriate identification is present to take delivery of the alcoholic drinks or other items, otherwise the delivery shall be withdrawn.
It is Your responsibility to check the condition of any products received, at the time of delivery. In case of breakage or damage to any packaging, You are advised to reject the products at that time and/or to make a note on the delivery slip stating the extent of the breakage and that will be used to time stamp the claim. Claims without any note on the delivery slip may be refused by Keyyes and our partners at our sole discretion.
In case of any comments or complaints, please lodge them to Keyyes' in-App live chat, or by email (email@example.com) as soon as possible but not exceeding 24 hours after delivery and also do not contact our partners directly in regard to products. Of course we do not restrict Your rights regarding contractual and mandatory law warranties You are entitled to. Keyyes may refuse to process late claims if there is a failure to lodge a claim in accordance with these Conditions. Depending on the situation, Keyyes, at our sole discretion, may offer You a replacement, a discount, a refund or an account credit to be used for a later purchase.
All risks in ordered products shall pass to You upon delivery but Keyyes shall retain title in the products until full payment has been received.
Replacements will only be made for goods that are deemed to be damaged upon inspection on delivery.
We will not accept cancellations, returns or replacements for products that have been in your possession for more than 90 days; for Wines, Spirits, or Sakes with vintages older than 20 years; for Port or Madeira with vintages older than 30 years; for products with a purchase price of more than SGD250 per product.
We reserve the right of final decision and interpretation in the case of any dispute.
All bookings will be kept for 15 minutes past the reservation time; any cancellations must be made 24 hours before your reservation time. Keyyes reserves the right to charge a cancellation fee of SGD 100 per booking for no-shows and for booking cancellations made within the 24-hour notice period, and the fee will be charged to the credit card registered with your Keyyes membership.
Cancellations and amendments must be made at least 4 days before your booking date. Keyyes reserves the right to charge the full booking fee for no-shows and for booking amendments or cancellations made within the 4 day notice period, and the fee will be charged to the credit card registered with your Keyyes membership.
Unless otherwise stated on the event registration page, cancellations received within
48 hours before the start of the event will receive a 50% refund. Cancellations received less than 24 hours before or no-shows to the event will not receive a refund.
Any cancellation should be made at least 24 hours before your reservation time. All bookings will be kept for 15 minutes past your reservation time. Please understand that your late arrival may result in a reduction of treatment time as a courtesy to the next guest.
Keyyes reserves the right to charge a cancellation fee of 50% of the price of treatment(s) booked for any cancellation made less than 24 hours but at least 12 hours before your reservation time, and 100% of the price of treatment booked for no-shows and for any cancellation made less than 12 hours before your reservation time.
Any cancellation fee will be charged to the credit card registered with your Keyyes membership.
Keyyes shall not be liable for any delay or failure in its performance caused by or resulting from acts of God, fire, flood, accident, riot, war, government intervention, embargoes, strikes, labour difficulties, equipment failures, or any other causes beyond the control of Keyyes and/or our partners.
All major credit cards are accepted.
All Membership prices are listed in local currency, unless otherwise stated. A limited period free trial Membership may be offered at Keyyes' discretion. No refunds of Membership fees shall be given.
Keyyes reserves the right to change the payment terms for any order without prior notice.
All GST and delivery fees are already included in the total price of the Membership. No additional fees will be charged.
MEMBERSHIP CANCELLATION AND TERMINATION
You may terminate your Membership prior to expiry of the then-current Membership payment period by giving not less than seven (7) days' notice to Keyyes.
If Keyyes’ or any of its partners' performance of any of its obligations under these Conditions is prevented or delayed by any act or omission by You, including without limitation any abuse by You of the Service, or failure by You to perform any relevant obligation (‘Member Default’):
(a) Keyyes shall without limiting its other rights or remedies have the right to suspend performance of its services or obligations under these Conditions until You remedy the Member Default, and to rely on the Member Default to relieve it from the performance of any of its obligations to the extent the Member Default prevents or delays Keyyes’ performance of any of its obligations;
(b) Where a Member Default subsists, Keyyes shall not be liable for any costs or losses sustained or incurred by You arising directly or indirectly from Keyyes’ failure or delay to perform any of its obligations; and
(c) You shall reimburse Keyyes on written request for any costs or losses sustained or incurred by Keyyes arising directly or indirectly from the Member Default;
Notwithstanding the foregoing, Keyyes may terminate Your Membership at its discretion on any ground at any time upon notice.
LAW AND JURISDICTION
Keyyes may revise these Conditions at any time without prior notice. If any dispute arises, Keyyes’ determination shall be final.
